Bantu Holomisa wrote : Former IEC CEO, Pansy Tlakula, must be fired ---------------------------------------------------------------------- The United Democratic Movement (UDM) welcomes the publication of the Public Protector’s investigation into maladministration and corruption in the procurement of the Riverside Office Park to accommodate the head offices of the Independent Electoral Commission (IEC). The UDM has been vindicated on a number of issues, in particular with the Public Protector’s finding, in Paragraph 10.7.1, that there was indeed an undisclosed and unmanaged conflict of interest between the then IEC Chief Electoral Officer, Adv. Tlakula, and Hon Mufamadi, her Chairperson and co-director in Lehotsa Investment Holdings. …. The Public Protector’s report, which is available on our website, states in Paragraph 9.17.2.7, that Adv Tlakula’s “…averment that she knew of no policy that she breached thus suggesting that where non- compliance is visited with a sanction, such provisions require clarity so that those to whom it applies must know what is expected of them, Adv. Tlakula was not entirely honest. She has been holding the Executive position of heading the administration of the Commission for a while and the policies referred to in this report where formulated and adopted whilst she was at the helm. By virtue of her seniority at the Commission, she should have considered her own integrity and the potential consequences in the event that a conflict of interest appears to exist.” … We entirely agree with the Public Protector that Adv. Tlakula’s improper conduct and maladministration, in particular the non-compliance with relevant procurement prescripts as well as her undisclosed and unmanaged conflict of interest had the impact of, amongst others: - Risking of loss of public confidence in the Electoral Commission as an organ of state in open and transparent procurement of goods and services; -Risking impairment of the reputation of the Electoral Commission as an impartial constitutional body with optimal levels of integrity; We call on the Commission to institute a forensic audit into the entire lease agreement and related expenditures. If Advocate Tlakula does not resign of her own volition, there is sufficient cause for the Commission to immediately fire, or at least suspend Adv Tlakula and the members of her executive committee that had been responsible for this maladministration and gross misconduct, until the forensic audit is concluded.
