Bargaining Factsheet 1 Mobility, Transfers and Vacancies Alberta Health Services and the other employers subject to the UNA Provincial Collective Agreement opened the 2013 round of bargaining with a proposal that would negatively im- pact Article 44, Mobility; as well as Article 14, Promotions, Transfers and Vacancies; Article 15, Layoff & Recall; and the Letter of Understanding entitled “Re: Merger or Division of Units.” The employer proposes: 1. To narrow the definition of position elimination in Article 44 to exclude permanent moves of less than 50 kilometres and temporary moves of less than 100 kilometres. This would effectively give the employer the right to unilaterally move any employee. Through a series of moves made by the employer, an employee current- ly working in Lethbridge, may find her job relocated to High Level. The employee would have no rights and would either have to move or resign. [See pages 116-126 of the employer Ingoing Non-Monetary Proposal.] 2. To change the Letter of Understanding on unit mergers and divisions. This would permit the employer to move employees on the same worksite without notice or per- mission. The employer could avoid posting vacancies, and instead just re-assign nurses from one unit to anoth- er. [See page 153 of the employer Ingoing Non-Monetary Proposal.] 3. To eliminate existing limitations on the ability of the em- ployer in Article 44 to require employees to work at more than one site for purposes of skill maintenance. This would allow the employer to use skill maintenance as an excuse to require arbitrary moves. [See page 90 of the employer Ingoing Non-Monetary Proposal.] 4. To remove from the agreement Article 44.03, Multi-Site Positions. This would make it easier for the employer to arbitrarily move employees to other units and other sites. [See pages 117-119 of the employer Ingoing Non-Monetary Proposal.] The combined effects of these changes would be to gut the provisions protecting nurses’ right not to be arbitrarily moved in Articles 14, 15 and 44. This is the first in a series of factsheets on UNA’s 2013 round of bargaining with Alberta Health Services and the other employers subject to the UNA Provincial Collective Agreement. The employer is seeking significant rollbacks in several areas important to Alberta’s nurses.
