Before anyone starts saying well, this is what they get for not going through the proper channels, then lets be clear: you cant make a claim for refugee status before coming to Australia (theres no pre-application process), and furthermore the government are deliberately preventing them going through the proper channels. Heres how things are meant to work: if someone comes here as an asylum seeker and is not a genuine refugee, they make a protection claim, the government processes that claim (by investigating the claims made within it), and then when that non-genuine refugees claim is found to be insufficient, we send them back. If, on the other hand, the claim is legit - as 92% of all claims are found to be - then were obliged under our human rights obligations to accept them into the country. And thats why were not processing peoples claims for refugee status: were not doing it on these boats, were not doing it on Manus Island, were not doing it in Nauru, were not doing it on Christmas Island, and were not doing it for those in mainland detention.
