Bernas, Dean Emeritus of the Ateneo De Manila University School of Law, said that though the high tribunal has already ruled that these acts are unconstitutional, the SC did not specify whether or not the decision is retroactive in nature. Bernas explained that if the decision is retroactive, it means that the funds used under DAP must be returned to the government coffers, but if it is not, the ruling will just be used as basis for future cases similar in nature. Bernas also pointed out that under the constitution, the president is immune from any lawsuit until he finishes his term. “The liability of the President after he finishes his term is only for unofficial acts. These are all official acts,” Bernas said.
