This bill is brought to you compliments of Human Society of the United States via the SD Animal Industry Board. The most onerous is the key point of the bill…causing 40-1-2.4 to be changed to say “No person may subject an animal to cruelty. A violation of this section is a Class 6 felony”. Under 40-1-1, the term “Cruelty” is amended to be “to intentionally, willfully, and maliciously inflict gross physical abuse on an animal that causes prolonged pain, that causes serious physical injury, or that results in the death of the animal. While the other sections in the chapter attempt to define limitations, this is nothing more than a broad stroke attempt to outlaw ALL animal related activities in the state…both meat production and hunting…its just a foundation step for future amendment. Every single definition is subjective excepting the word kill…and even that could be manipulated…what is humane for example…it still ends in dead? The play book of lobbying is to chip away at an issue a winnable piece at a time until you have changed the law to say what you want it to…existing safeguards notwithstanding, several of the changes in this lengthy and confusing bill-on line item merit-could easily be argued or negotiated and a court ruling could change the intent of the law. We all agree animal cruelty is unaccceptable, but we currently have strong laws in place to address those rare occasions. Agriculture is our number one industry and rodeo our number one sport.
