Books of ibn Taymiyyah in prison VS fatawa against dawlah from prison ===================================================== there is a difference between, a) Bayaan of Ahkaam. b) Fatwa BAYAAN Bayaan of ahkaam is to explain what the divine texts say about the ahkaam in general. Anyone who has knowledge can write about these things even from prison - as long as he was not pressured to write something, his words about ahkaam in general is allowed. FATWA A fatwa is an answer to a question about the application of the ahkaam on a specific case or circumstance. This requires investigating the reality of that individual person and his cirucmstances, and verifying all information and evidence about it AS WELL as knowledge of the deen and ahkaam in order to apply it to the reality. In order to give a fatwa - you need to be able to investigate the reality of the case properly and the mufti in prison has diminished competence (ahliyyah) to investigate people and their realities and could be under pressure and is dependant on what information is given to him by those who are free. a sheikh in prison can do his best but his fatwa will never be given the same weight as someone who is more able to check the reality and is without pressure form his captors.
