CAPS policy and L&N spread sheet LR has continued to advise us of this new points system policy for handling absenteeism issues and discipline. Our office along with all the other SMART-TD General Chairmen are in dispute with this policy and will handle that dispute as a collective whole going forward. For now every trainman and engineer on the CSX property is being sent letters to convey this new policy. The letter and examples I have provided from CSX are in error and they never sent our offices the correct versions, where there is an issue on the days where penalties apply. The correct letter will state that it is Mon-Thu and Fri thru Sun. You should all be aware the points are based on each day and not event. For example if you have the flu and provide a medical excuse under the policy that does not meet their MGT policy then you will receive 3 points for each day. To put in perspective, consider : You have the flu and are out for 4 days and went to your own Doctor and submitted an excuse that is not accepted per the MGT, then you will receive 12 total points. Then after those 4 days you return to work and get a missed call, now you have 22 points and are charged. As advised before concerning submitting proper medical excuses that are not accepted and points are submitted to your record, I would seek designated legal counsel or your SMART-TD State Director for handling a claim to the DOL and OSHA. Their selling points to this policy are that this is what the employees have requested to them and that the employees have a way to work off the points. We find that is a possible violation of the Railway Labor Act and our rights to grieve any discipline assessed and points are discipline. We understand the BLET is also of the same mindset and are disputing this point system. For now this is the policy we will live under and we need to advise our peers. The information will be shared for the employees on a website for them to keep up with their points.
