CASE ROUND-UP Phong Ma, a Solicitor within our Immigration Team, submitted an application to the Home Office to register a child under the age of 18 years as a British citizen who had been born and resided in the UK for at least 10 years. The parents had recently acquired settled status in the UK. The child’s stay in the UK had largely been legal but in the later parts of his residence had remained in the UK without leave to remain. Appropriate representations and relevant personal evidence were submitted to the Home Office so as to fulfill the requirements of Section 1(3) of the British Nationality Act 1981 as to why the child was entitled to registration as a British citizen. Of course, alternatively the child could have applied for registration as a British citizen under Section 1(4) of the British Nationality Act 1981. A swift and positive decision was made by the Home Office and a Certificate of Registration has recently been issued. The child can now apply for a British Passport. Great result!
