The Walmart 18-wheeler rammed into Tracys vehicle, causing the death of one passenger and horrible injuries and broken body parts for Tracy and others. But in their response, Walmart blames Tracy for his own injuries...because he wasnt wearing a seatbelt! “Plaintiff’s injuries, if any, were caused … by plaintiff’s failure to properly wear an appropriate available seatbelt restraint device. By failing to exercise ordinary care in making use of available seatbelts … plaintiff acted unreasonably and in disregard of [their] own interests.” The response was made in court papers filed in New Jersey federal court Monday. Benedict Morelli, Tracys attorney, responded to Walmarts claims saying, “After Walmart told the public and their customers that they would take full responsibility, they put responsibility on my clients and the deceased — which I think is despicable. Tracy is struggling and struggling and he’s sitting in a wheelchair and they’re blaming him. It’s disgusting.” We have to agree. While Tracys legal team (and authorities) blamed Walmarts driver Kevin Roper for the crash, Walmarts response is going with the mantra that it is “unable to admit or deny” various allegations made by Tracy and his team about the crash.
