CIVIL DISOBEDIENCE If you believe that Obamacare is unconstitutional, or you just don’t want to pay its penalties, DON’T! In chapter 48 of the Patient Protection and Affordable Care Act, there are two little known but tremendously important provisions that all American citizens should be aware of. If you do not have “minimum coverage,” as defined by the government, and you choose to not pay the fine, or tax (whichever you prefer to call it), there is little if anything the federal government can do to you, for the law specifically prohibits criminal prosecution and penalties, as well as liens and levies on your property. As far as I can tell, the only possible way for the IRS to get the money, is to assess an “offset” to your tax refund, meaning to deduct the amount of the penalty from your refund. This can usually be resolved by choosing zero deductions on your W2, so that you are never owed a refund, but rather have to send the IRS a check at tax time. You should never have a refund coming anyway, for that is a tax free loan to the federal government, which it should never get. It is already borrowing too much! ‘‘CHAPTER 48—MAINTENANCE OF MINIMUM ESSENTIAL COVERAGE ‘‘(A) WAIVER OF CRIMINAL PENALTIES .—In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure. ‘‘(B) LIMITATIONS ON LIENS AND LEVIES .—The Secretary shall not— ‘‘(i) file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section, or ‘‘(ii) levy on any such property with respect to such failure.’’.
