COCA COLA WINS, CONSUMERS LOSE When it comes to the battle over the misleading marketing of vitamin water as a healthy drink, consumers may soon lose an important fight with beverage giant Coca-Cola. A proposed settlement pending in federal court in Ohio would award attorneys $1.2 million for suing the company, but give nothing to consumers who bought the drink based on the marketing that it was a healthy alternative to soda. TINA.org’s analysis of the settlement reveals that it’s a raw deal for consumers. This agreement simply pays off the class-action lawyers to make the whole case vanish. Unlike the widely publicized $13 million Red Bull deceptive advertising settlement, which allows consumers who bought the product to get a cash refund, Coca-Cola is not providing any reimbursement to consumers in this settlement.
