CONDEMNED BROWNSVILLE MAN LOSES KEY APPEAL A death row inmate from Brownsville is a step closer to his execution. Ruben Gutierrez, sentenced to death for the 1998 murder of the elderly owner of a mobile home park, lost a federal court appeal Thursday. Gutierrez appeal attorneys had argued several points including improper questioning by police after his arrest and by prosecutors during his trial. They also claimed juror misconduct, and lack of sufficient evidence. The 5th Circuit Court of Appeals rejected each point. Gutierrez was found to have broken into the home of 85-year-old Escolastica Harrison, intending to get into her safe. When she struggled, she was beaten and stabbed with a screwdriver. Gutierrez fled with 56-thousand dollars.
