HERRERA, CAMPOS, BURTON STAND UP TO NEWSOM & STATE LANDS COMMISSION TO PROTECT SAN FRANCISCOS VOICE ON WATERFRONT Two weeks ago, Gavin Newsom and the California State Lands Commission filed a radical lawsuit against the People of San Francisco seeking to overturn Proposition B, waterfront height limits, and silence the voice of the city of San Francisco on development along the San Francisco waterfront. Since then, a diverse group of voices across San Francisco have begun coming together to work hard to defend the voters and our citys right to have a say on the waterfront. First, SF City Attorney Dennis Herrera issued an immediate statement pledging to vigorously defend Prop. B and the citys participatory process that enacted a comprehensive Waterfront Land Use Plan in 1990, developed a showplace ballpark for the Giants, and continues to protect an urban waterfront that is the envy of cities worldwide. Next, Supervisor David Campos, along with Supervisors Eric Mar and John Avalos, introduced a resolution at the Board of Supervisors calling for the Board to stand behind City Attorney Herreras defense of the will of SF voters. The Board will hold a hearing on the resolution in September. (read the proposed resolution by clicking here) Then, California Democratic Party Chairman John Burton - who, as San Franciscos State Assemblyman in 1968, sponsored the seminal law transferring ownership of the San Francisco waterfront from the state to the City and County - issued a blistering statement challenging the State Lands Commission lawsuit, saying: I am outraged to hear that the State Lands Commission, which is made up of three individuals, has filed a lawsuit to keep San Franciscans from having a say in the future of our waterfront. That these three individuals – none of whom live in San Francisco – would seek to overturn a measure that was easily passed by 58.8% of San Francisco voters is a bad canard to say the least. This lawsuit only benefits developers, not San Franciscans. Proposition B does nothing to limit the ability of the State Lands Commission to review the impact of developments on their jurisdiction. It merely gives the people of the City and County of San Francisco the ability to approve or deny developments that exceed currently zoned height limits. As the author of the Burton Act, which transferred control of the Port of San Francisco from the state to our City, I strongly support City Attorney Dennis Herrera’s defense against the misguided lawsuit brought forth by the State Lands Commission that will only benefit developers and in no way protect the interests of San Franciscans, or even the people of the State of California.
