California recognizes three types of wills : Witnessed wills, Statutory form wills, and holographic wills. A WITNESSED WILL - usually prepared by an attorney, is signed by the maker ( testator ) and is witnessed by at least two persons. STATUTORY FORM WILL - any person over the age of 18 and of sound mind may execute a Statutory Form Will. A statutory will requires two witnesses and can be amended by codicil ( A CODICIL is a later testamentary instrument that supplements or affects the validity or dispositions of an earlier will, regardless of what type of a will ) . HOLOGRAPHIC WILL - is a will entirely in the handwriting of the testator. Unlike a regular will, a holographic will does not require witnesses. Under former law, a holographic will had to be dated. Now, the law does not required this directly.
