Can NY Doctor Claim Nothing Done Wrong Since Hes Never Been Sued? New York Medical Malpractice Attorney Explains 516-487-8207 Email: Gerry@Oginski-Law In a medical malpractice lawsuit in New York, an injured victim will claim that their doctor violated the basic standards of medical care and as a result they suffered significant harm. The doctor will typically raise three defenses: 1. We did nothing wrong. 2. If we did something wrong, so did you. 3. Maybe we did something wrong but the injuries you are claiming are not worth what you think they are worth. There are some doctors and defense attorneys who would like nothing more than to add another defense.
