Cant Join Competitors - Refuse To Give Release I have been working in a private university since August 2009. Now the company has terminated me and I have found a job in another private university in Kuwait. But my current company is refusing to give me a release to join another private university saying that, I can’t join a competitive private university in Kuwait for the next one year. The same is also mentioned in my contract. My contract is dated August 2009, before the new Labor Law was enacted. But now my company is following the new Labor Law. (For an example my contract says, termination of the contract with 1 month’s notice. But now, my company is giving me 3 months notice, which means they are following the new Labor Law). Please advise me … Is there any way I can get a release? Answer: First of all, the company is right on most counts. Whenever a new Labor Law is enacted, it replaces the old one and everything must be done according to the new one. This is also mentioned in the new law.Secondly, if it is mentioned in your contract that you can’t join a competitive university for one year after you leave your current establishment, then the company can ask the Ministry of Social Affairs to ensure that such a transfer doesn’t take place. This is also in the law. Thirdly, the company is right in giving you a three-month notice because that is according to the current law.In spite of the above, the company has to give you a release and can’t stop you as long as you don’t join a competitive private university.
