Cavuto is ultimately going to be proved right. I heard a Republican today say, why shouldnt we be able to sue, were suffering the same injury that every other American is suffering as a result of Obamas violations of the law. Well, pardon me for slipping into law professor mode, but that statement proves the problem with House Republicans thinking that a court will find that they have standing to sue. They do not have any discrete injury different from the rest of us. This is the essence of the issue: if everyone is hurt in the same way, then one of the important components of standing to complain fails.
