Shri Girija Shankar Jaiswal submitted RTI application of 1 October 2010 before the CPIO, State Bank of India, Varanasi to obtain information regarding grant of car loans by the city branch, SBI, Varanasi, to persons for purchase of cars from agency which as per the appellant did not exist. Appellant also sought information regarding loans advanced to railway officials by the Singra branch of the Bank against whom Civil Suits had been filed in court for nonrecovery. 2. Vide CPIO order of 21 October 2010, disclosure of information was denied by citing the provisions of section 8 (1) (d) and (j) of the Act. 3. Appellant preferred appeal dated 15 November 2010 before the first appellate authority. 4. Matter was disposed of vide FAA order of 1 December 2010 vide which the order of the CPIO was upheld. 5. Appellant moved the Commission in second appeal. Appeal: No. CIC/DS/A/2011/000754 2 6. Matter was heard today via videoconferencing from Lucknow and Varanasi where respondent as above was present. Appellant made submissions from Varanasi. Appellant pressed for disclosure of the names and other particulars of the persons who was sanctioned loans on the grounds that fraud had been committed by these persons on the Bank which was the custodian of public money and that the Bank had not taken adequate action against these persons. Respondent stated that in the first matter, the matter was under investigation by the Vigilance Department of the Bank and after the investigation was completed, F I R would be filed against the erring parties (borrowers and dealer). In respect of the matter of the Sigra branch of SBI, respondent clarified that the matter was not a case of criminal impersonation by any of the borrowers. However this was a case where accounts had gone bad and that civil suits had been instituted against the defaulters. Decision notice 7.
