Centre For Multilevel Federalism New Delhi based Institution yesterday organize a Panel discussion on- Towards Federalism: Constitutional Developments in Nepal. Prof. Lok Raj Baral, Uddhav Pyakurel and myself was the panelist. The program was jointly Chaired by Prof. Balbir Arora and Pro. MP Singh. Experts of my talk: - Issue of Federalism became the most complex issue in Nepalese Constitution making process. Federalization of a unitary state is itself is a huge and complex undertaking. - State restructuring is multidimensional task. It is a part of nation building. It should not limited only to federalization process. - In Nepal, discourse of federalism is overwhelm by carving out of provinces, name and boundary of federal units. There is least discussion about the institutional arrangements on federalism. Federalism is political notion. The provinces are political body derived power, directly from the Constitution itself. - Federalism require a genuine and inclusive democracy. Only under the genuine democracy the power can be devolved. - In Nepal discourse on Federalism became emotive. Creating provinces only on ethnic basis might be a recipe for disaster. The proper balance needs to be strike between viability and identity. This is a era of multiple identity. If provinces are not economically viable than there would be no self rule. - Nepal needs a workable model of federalism. - Independence of judiciary is a central tenet of federalism. In addition to have a powerful judiciary there must be a room for informal dispute settlement mechanism inbuilt into the Constitution. - Under the federal arrangement- The center needs to effective and provinces needs to be empowered. - Nepalese federal arrangement needs to be inform by emerging human rights notions. The strong bill of rights needs to be entrenched into the Constitution. There must be guarantee against discrimination. There should be a neutral name for the provinces.
