Changes to Medicaid (ATTN personal injury and insurance defense lawyers): Amendment to H.J Res. 59 (offered by Paul Ryan of Wisconsin), passed by Congress and signed by the President on December 26th: The legislation makes changes to sections 1902(a)(25), 1912 and 1917, giving states the ability to recover costs from the FULL AMOUNT of a beneficiarys liability settlement, instead of only the portion of the settlement designated for medical expenses. It also establishes an option for states to place liens against Medicaid beneficiaries liability settlements. We discussed this in the NYSBA TICL Section meetings during the past week and we plan to have a position paper ready for February 2014. However, you should all be aware of it now. The law takes effect on October 1, 2014.
