Clayton Miller review will be thorough, says medical examiner We have to keep a very objective and very scientific perspective NEW WATERFORD — Nova Scotias chief medical examiner is conducting such a detailed review into the death of Clayton Miller 24 years ago, that hes even visited the site where the young boys body was found. I do like to personally walk through the scene because I think it gives you a better feel for the case, said Dr. Matt Bowes. Bowes said his investigator and photographer from the medical examiner service accompanied him. A member of the Cape Breton Regional Police brought me through. He admitted that actually going to the site of a tragic death can sometimes make it difficult to separate oneself from the investigation, but he feels that this is what has to be done. This is what we have to do. We have to keep a very objective and very scientific perspective. In September, Nova Scotia Minister of Justice Lena Metlege Diab committed to a review of new information in the cause of death of Clayton Miller, 24 years ago. In a statement, Diab said her department received a review of the previous two autopsies of Clayton Miller that was conducted by Kate Dwyer of Chester, a retired nurse, and then directed that the report be forwarded to Bowes for review. Dwyers report was critical of the autopsy. Further investigation of Claytons death is necessary as there was either an accident and or foul play and it appears that a poor and despicable job was done of his autopsy, Dwyer wrote. Bowes said he doesnt know when he will be finished the investigation but he speculates that it could be completed by late winter or early spring. I cant commit to that, though, because one never knows with these complex cases. He said he received 17,000 pages of documents from the RCMP. Some of these pages have to be read in some detail. It does have to be done carefully. I have promised the Millers (Claytons parents, Gervase and Maureen Miller) that I would be careful and thorough and I intend to do that for them. He said he did speak to the Millers about the time element involved and the Millers indicated they wanted him to take the time needed to do a proper investigation. She (Maureen) said that to me directly and I very much appreciate that. One of the toughest messages to send is that these things take time. She certainly is very understanding about that. He said people have been helpful during his investigation. Theres a wealth of information, people have been very co-operative. It has taken longer than I expected, theres more documents than I anticipated. He said he is committed to meeting with the Miller family in person, as well. I did want to have that meeting after Ive done at least the bulk of the review of the documents. I dont like to attend a meeting unless Im very knowledgeable about the case. When the news of the review came down in September, Maureen Miller was happy to hear the news, but remains cautious. Because of being let down so many times, I dont get my hopes up, she said. I just hope theyre sincere and this will be an honest review. Miller said Dwyer’s review revealed that the dislocation of her sons elbows was in the autopsy but wasnt stressed or commented on by Dr. Butt, who did the initial autopsy, and the gash on the back of his head and missing teeth werent mentioned at all.
