Contentious Constitutional Issues: Politics of Defection, Eligibility and Resignation In Nigeria Does the IGP of police has the constitutional power to withdraw security personnel attached to any high ranking political officers? It is trite that no aspect of the Constitution is self executory by executive arms without the activation of same before the court of law except where legislature is saddle with powers to discharge certain functions and the laid down procedural niceties must be strictly adhere with. We humbly submit that the purported directive of IGP withdrawing security personnel to Rt. Hon Aminu Tanbuwal, CFR, Speaker of House of Reps is unconstitutional and illegal. It is a travesty of constitutional provisions and amount to usurpation of legislative and judicial functions within the contemplation of sections 6 (6)(b) 50 (2) (a) and (b) and 68(2) of the 1999 Constitution (as amended.) It is therefore absurd for Police to hide under the guise of section 68(1)(g). The directive of the IGP reads thus as contained on Vangaurd newspaper #0th October, 2014 “In view of the recent defection by the Right Honourable Aminu Waziri Tanbuwal, CFR, the Speaker of the House of Representatives of the Federal Republic of Nigeria, from the People Democratic Party (PDP) to the All Progressive Congress (APC), and having regard to the clear provision of Section 68 (1) (g) of the 1999 Constitution of the Federal Republic of Nigeria as amended, the Nigeria Police Force (NPF) has redeployed its personnel attached to his office.
