Could this happen in Brunei? Below is a disturbing story about a case in Malaysia, where both civil and Sharia law are practised. In this case, a newly converted Muslim man ran away with his 11 month old daughter following her Hindu mothers refusal to convert to Islam. This was more than five years ago and the mother has not seen her daughter since, despite the civil court ruling that the girl must be returned to her mother. The Sharia court ruled in favour of the father and the police have refused to carry out the orders from the civil court. Furthermore, the Sharia court granted custody of the couples two other children to the father after he converted them to Islam without their mothers consent. How such a case would play out in Brunei under the Syariah Penal Code is hard to say. Certainly the odds of a non-Muslim parent winning custody of a child from a Muslim parent would be very low and even if they did, they would likely be heavily constrained in how they choose to raise their child, given that the child would most likely be considered Muslim and therefor protected from other religious influence under section 212 of the Syariah Penal Code.
