Court interdicts gold sector strike – 30 January 2014 – The Chamber of Mines had applied for an interdict at the court against Amcu members last week.(SABC) The Labour Court in Johannesburg has ruled that Association of Mineworkers and Construction Unions (Amcu) members cannot go on strike in the gold sector. The Chamber of Mines had applied for an interdict at the court against Amcu members who intended to down tools in the sector. Delivering judgment in this matter Judge Edwin Molahlehi ordered that the Amcu strike in the gold sector will be illegal . Judge Molahlehi says it will be the responsibility of Amcu officials to tell its members that they cannot go on strike, for now, as the industrial action will be declared unprotected. As this is an interim order, Amcu lawyers have been given until March 14 to explain to the court why the order should not be made final. AMCU members who came to court were upbeat, singing freedom songs ,despite having lost the case. The Chamber of mines has welcomed the judgment. Mineworkers booed and jeered when a 9% offer was put to them, by union officials, who have been demanding 12.5% Last week, Amcu served three major platinum producers and some gold mines with notices for the strike. The union is demanding a R12 500 monthly salary. Chamber of mines had said they negotiated wages collectively with the three gold companies during the course of last year and Amcu was part of the negotiation.” Amcu has rejected a 9% wage offer from leading platinum producers Anglo American Platinum and Lonmin, ensuring a week of industrial action continues. Mineworkers booed and jeered when a 9% offer was put to them, by union officials, who have been demanding 12.5%. The third strike-hit major platinum producer, Impala, is expecting the same outcome.
