Currently, 16 states (California, Colorado, District of Columbia, Nevada, Oregon, Vermont, New Jersey, Hawaii, Illinois, Iowa, Maine, Minnesota, New Mexico, Rhode Island, Washington, and Connecticut) and at least 139 cities have laws that prohibit discrimination based on “gender identity” and/or “gender expression.” In summary, if a state or local law protects gender identity and/or expression where your company is operating, you should beware to enforce the dress code in a way that imposes stereotypical appearance standards regarding gender.
