DANS FABLES CHAPTER 9: Today Aaron Prisbrey met with City Attorneys Guzman and Houston to discuss the proposed 1983 lawsuit. Rather than discussing the merits of the lawsuit, Prisbrey was presented with another chapter of what he likes to call Dans Fables, a series of truth defying actions orchestrated by the city apparently designed to make sure we cannot believe a word they tell us. Here is a recap: CHAPTER 1: When CAITS filed its original GRAMA request, we were told to get ready to pay upwards of $5,000; actual costs $155.20 CHAPTER 2: After a two and a half hour meeting with Guzman and Houston a month ago, Prisbrey was promised that his amended narrowly tailored GRAMA request would be processed the next business day; After ignoring us for five days, Houston told Trevor that the request couldnt be processed because of a software problem CHAPTER 3:The next day when Guzman and Prisbrey talked, Guzman told Prisbrey that the computer software problem couldnt be resolved, that he had talked to the software company and everything. The next day the GRAMA information was printed and ready to go. (After Prisbrey told Guzman that he was going on Perspectives with Bryan and Kate and the topic on the radio was going to be why Shawn Guzman is suppressing the vote in St. George). CHAPTER 4: In the Rowley code enforcement case, Houston told Prisbrey that any legal documents in the case needed to be sent to her and she would get them to the judge. Prisbrey sent the documents regarding code enforcements illegal spying to Houston, but she didnt get them to Judge Filter. (Interestingly enough Filter said on the record that if he would have received Prisbreys Memorandum before the hearing, he could have ruled the search was unconstitutional without even having a hearing). CHAPTER 5: Houston told Prisbrey that the purpose of the first settlement conference regarding the merits of the lawsuit would address only the warrantless searches, not the any of the issues CAITS had regarding the other ordinances. When Prisbrey arrived for the conference, Guzman initially announced that the purpose of the conference would be only to discuss the CAITS issues, not the lawsuit. CHAPTER 6: At the close of the initial conference, Prisbrey was told that Houston would present his proposal to the city council in a closed door meeting. However no presentation was ever made as City council was cancelled (by you know who). CHAPTER 7: Last Friday Guzmans assistant told Prisbrey that legal had no idea who had cancelled city council and that Guzman would contact each council member before Tuesday, when Prisbrey and Guzman were to meet again, to see where the city council stood on the offer. When Guzman and Prisbrey met Tuesday, Guzman stated he had no such conversation with his assistant and he had not contacted the city council individually regarding the lawsuit. CHAPTER 8: While the meeting on Tuesday was scheduled to find out where the the council stood on the lawsuit, Prisbrey was informed that was not going to happen and instead of taking the offer to the city council, Mayor McArthur and City Manager Gary Esplin would address settlement with Prisbrey and the Citys attorneys on Thursday. What could CHAPTER 9 possibly involve? The possibilities are endless. Will the city agree to amend the ordinances that purport to allow code enforcement to enter our properties without a warrant? Will the city agree to reimburse fines to those whose property was searched without a warrant? Or will the Mayor and City manager simply have Prisbrey down to discuss the latest fashions of Gentlemans Quarterly? The anticipation is almost palpable.
