DAY 41: ROUX URGES COURT TO ACQUIT OSCAR In his closing arguments on day 41 of the Oscar Pistorius Trial, Advocate Barry Roux told the court that Oscar Pistorius did not intend to shoot Reeva Steenkamp and if it was found that he acted out of reflex, with no cognitive function, he should be acquitted of the murder charge. He also argued that this was not a case of dolus directus or dolus eventualis. He added that the state should not have right of reply on facts, only on the law, in wrapping up their closing arguments. Judge Masipa addressed the state and the defence, asking if Darren Fresco should receive indemnity against prosecution for his testimony. Nel argued that he should receive indemnity while Roux argued that Fresco was not a reliable witness and should not receive indemnity, even though it would then be up to the prosecution to decide whether or not to prosecute him. Nel added that Pistorius’ two defences – putative self defence and automatism or involuntary action - were mutually destructive. Judge Masipa thanked both legal teams for their assistance to the court and announced that she would read her judgement on 11 September
