DELICATE THINGS CANNOT BE HANDLED IN HARD WAY July 8, 2014 at 4:24am The naked human body without any clothes covering such body is hard material truth of Nature and the clothes covering human body out of shyness of human mind is soft spiritual truth of Nature. The human mind is required by law of Nature to take care of both these truths of Nature relating to human life and human conduct. However, the difference between these two truths of Nature is that while the hard material truth is concrete truth, the soft spiritual truth continues to be an abstract truth. The concrete truth is fundamental truth and abstract truth is only supplementary to fundamental truth. The high moral values such as love, kindness, modesty, humility, generosity etc. and God related divinity carried by human mind in abstract form are part of such supplementary truth viz. soft spiritual truth as aforesaid. The human behavior is actually the behavior of human mind and such behavior is of two forms viz. (1) hard material behavior in concrete form, and (2) soft spiritual behavior in abstract form. The hard material human behavior is required to be handled in hard way in terms of hard criminal law and the soft spiritual human behavior is required to be handled in delicate way in terms of soft civil law. The criminal law is not required to be cultivated in human mind by reformative method of law. It is actually required to be enforced upon human mind by deterrent method of law involving hard criminal way. On the other hand, the civil law is required to be cultivated in human mind by reformative method of law involving soft civil way. Since the civil law is a delicate thing, it cannot be enforced upon human mind by deterrent method of law involving hard criminal way. It is a well known truth of Nature that delicate things cannot be handled in hard way. The soft civil law cannot be made as hard criminal law by artificial/man-made conversion by way of State codification of such civil law as criminal law. The civil law is a delicate issue because of abstract nature of soft spiritual part of human mind. The civil law is therefore always going to be a testing point of human modesty and a permanent challenging point of civil governance of State. The criminal law has its own style of working and the civil law has its own style of working. The hard criminal law cannot be worked with in soft civil way and the soft civil law cannot be worked with in hard criminal way. In fact, these two different laws should follow their own paths and should not be allowed to interfere with each other at voluntary human instance. But since the human mind is a complex mixture of hard materialism and soft spiritualism, the line between criminal law and civil law becomes very thin in governance of human conduct and this fact keeps human mind always restless and unstable/fugitive making it a target of manipulation/corruption almost at all time. The achievement of material success by corrupting human mind/s is therefore a very easy task. What is difficult in human life is to remain non-corrupt in the midst of all tempting fears and/or favors. –Adv.B.S.More
