DEMOCRACY AND ELECTION; KUFR OR EEMAAN? [Part one] All praise and adoration is due to Allah, I praise Him, seek His assistance and His forgiveness. I then seek refuge with Allah from the evils of our souls and from the mischief of our deeds; whomsoever Allah guides no one can mislead him and whomsoever He misleads no one can guide him. I then testify that there is no deity worthy of worship except Allah alone, He has no partner and associate. I also testify that Muhammad is His servant and His Messenger; “O you who believe, fear Allah as he should be feared, and die not except as Muslims.” “O mankind fear your Lord who has created you from a single soul and created from it its spouse and created from the two, men and women, and fear Allah through from whom you demand your mutual rights and be heedful of the family ties, verily Allah ever watches over you.” “O you who believe fear Allah and say righteous words, He would rectify your affairs and forgive you your sins and whoever obeys Allah and his Messenger has profited greatly.” To proceed: “The truthful Book is the Book of Allah, and the best of guidance is the guidance of Muhammad (salla llahu ‘alayhi wa sallam) and the worst of issues is that which is innovated (in the religion), and every single innovation (in the religion) is bid’ah, and every single bid’ah is a going astray and all going astray is in fire.” As for what follows, democracy and participating in the democratic election are either kufr or eemaan. And it is not possible for one to be a democratic Muslim, it is either Islam or democracy. The Prophet salla llaahu alayhi wa sallam said: “Eemaan and Kufr (disbelief) cannot co-exist in the heart of a person.” (Silsalatul ahaadeeth As-Saheeha by Shaykh Albaani No.1050) I say: Democracy is an idolatrous method of establishing an Islamic State. الديمقراطية وسيلة شركية لإقامة الدولة الإسلامية The term democracy is derived from the Greek word demoskratein: (demos), i.e. the people, and (kratein), i.e. to rule. This term has therefore been defined as the rule (governance) of the people, for the people, by the people. Thus, in democratic society the supreme source of legislation is the populace (i.e. the people), as opposed to Allah subhaanahu wa taaala - a doctrine in direct opposition to Islamic teachings, because legislation is for Allah, the Most High, the Almighty, and it is not permissible to give legislative rights to any human being, no matter who he is. It is a duty upon us to distance ourselves from shirk and its people. And do not be mistaken to think that you can only fall in shirk by worshipping graves, or to ask/call someone other than Allah, or to invoke awliyaa in order to obtain mercy, wealth, and healing. That is shirk which there is no doubt about it. But there are other types of shirk, like shirk al-Mahabbah (loving other than Allah), shirk at-Taa’ah (following/obeying other than Allah) and the shirk of giving the legislative right to other than Allah be it to Parliament, honourables or any other being, because Allah subhaanahu wa taaala says: {...and He shares not His legislation with anyone.} [Al-Kahf 18:26] {Or have they partners (false deities) with Allah, who have legislated for them in the religion that which Allah has not allowed. And had it not been for a decisive word (gone forth already), the matter would have been judged between them. And verily, for the Zâlimûn (polytheists, disbelievers), there is a painful torment.} [Ash-Shuura 42:21] So it’s an obligation to disbelieve in those Musharr’een (Legislators). It says in Mawsuu’ah al-Adyaan Wal-Madhaahib al-Mu’aasirah (2/1066, 1067): Undoubtedly the democratic system is one of the modern forms of shirk, in terms of obedience and following, or legislation, as it denies the sovereignty of the Creator and His absolute right to issue laws, and ascribes that right to human beings. Allah says: {You do not worship besides Him but only names which you have forged — you and your fathers — for which Allah has sent down no authority. The legislation is for none but Allah. He has commanded that you worship none but Him; that is the (true) straight religion, but most men know not.} [Yusuf 12:40] {The decision is only for Allah.} [al-An’aam 6:57] End quote. [See; Mawsuu’ah al-Adyaan Wal-Madhaahib al-Mu’aasirah (2/1066, 1067)] Shaykh Allaamah Ash-Shinqiti-may Allah be merciful with him- said: To commit shirk with Allah in legislation is of the same meaning as to commit shirk in his worship, there is no difference between the two in any manner. There is no difference in any sense between he who follows a system (nidhom) other than Allahs system or law other than Allahs law (shareeah) and he who worships an idol or prostrates to a false deity. They are the same and both are polytheists [Mushrikuun] with Allah. [Adwaaul-Bayaan, 7:162] Deciding what is Halaal (permissible) and what is haraam (forbidden) is for none but Allah (And it is a form of tashree (legislation) Allah azza wa jalla says, {The decision is only for Allah.} [al-An’aam 6:57] A Muslim is obliged to subscribe for Allahs decision only, in every matter by following the commandments in the Quran and Hadeeth. {It is not for a believer, man or woman, when Allah and His Messenger have decreed a matter that they should have any option in their decision. And whoever disobeys Allah and His Messenger, he has indeed strayed in a plain error.} [Al-Ahzaab 33:36] And Allah Ta’ala also said: أَلَمْ تَرَ إِلَى الَّذِينَ يَزْعُمُونَ أَنَّهُمْ آمَنُوا بِمَا أُنزِلَ إِلَيْكَ وَمَا أُنزِلَ مِن قَبْلِكَ يُرِيدُونَ أَن يَتَحَاكَمُوا إِلَى الطَّاغُوتِ وَقَدْ أُمِرُوا أَن يَكْفُرُوا بِهِ {Have you not seen those [hypocrites] who claim that they believe in that which has been sent down to you, ancd that which was sent down before you, and they wish to go for judgement [in their disputes] to the Taaghut [false judges; those who judge with other than Allahs Shareeah] while they have been ordered to reject them.} [An-Nisaa 4:60] {But no, by your Lord, they can have no eemaan, until they make you (O Muhammad) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission.} [An-Nisaa 4:65] Imaam Ibn Hazm rahimahullaah said: Whoever seeks the judgment other than that of the Messenger salla llaahu alayhi wa sallam is not a believer, and if he is not a believer, then he is a disbeliever- and there is no third way in this! [Al-Ihkaam fee Usuul al-Ahkaam 1/98] If this is the ruling of Allah concerning the one who wants to refer for judgement to false judges, then how about the false judge himself who promulgates laws instead of Allah. How can legislation that is contrary to the laws of Allah not be kufr, when it inevitably implies permitting that which is forbidden and forbidding that which is permitted, or giving the legislators the right to do that, so they have the right to permit whatever they want and to forbid whatever they want; whatever the majority agrees upon must be carried out and the one who goes against it is punished and criminalised. This is the ultimate kufr. Allah azza wa jalla also says: {The postponing (of a Sacred Month) is indeed an addition to disbelief: thereby the disbelievers are led astray, for they make it lawful one year and forbid it another year in order to adjust the number of months forbidden by Allah, and make such forbidden ones lawful. The evil of their deeds seems pleasing to them. And Allah guides not the people, who disbelieve.} [At-Tawbah 9:37] So here, Allah, subhanahu wa ta’ala, shows to us how making halaal, what is haraam is only an increase in kufr. Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said: If a person regards as permissible that on which there is consensus that it is forbidden, or regards as forbidden that on which there is consensus that it is permitted, or he alters a law on which there is consensus, then he is a kaafir and apostate, according to the consensus of the fuqaha’. End quote from Majmoo‘ al-Fataawa, 3/267 Ibn Katheer (may Allah have mercy on him) said: The one who forsakes the law that was revealed to Muhammad ibn ‘Abd-Allah, the Seal of the Prophets (blessings and peace of Allah be upon him) and refers for judgement to any other law that has been abrogated, has committed an act of kufr, so how about the one who refers for judgement to al-Yaasa and gives it precedence? The one who does that is a kaafir according to the consensus of the Muslims. End quote from al-Bidaayah wa’l-Nihaayah, 13/139. Note: Al-Yaasa (also known as al-Yaasiq) refers to the laws of the Tatar Genghis Khan, who forced the people to refer to them for judgement (just like the accursed Nigerian constitution). And this is what we see happening today, you see the courts ruling with accursed Man-Made laws amongst the people, even if in some places they don’t name it by its real name. What matters is the meanings and the facts, not the names and the deception. Imaam Ibn Hazm rahimahullaah said: If someone prohibits something that was permissible during the time of the Prophet salla llahu alayhi wa sallam or makes permissible something that was prohibited during the Prophet salla llahu alayhi wa sallam or makes a punishment obligatory (for a certain crime) which was not obligatory during the Prophet salla llahu alayhi wa sallam or legislates a legislation which was not existent during the Prophet salla llahu alayhi wa sallam - then he is an infidel polytheist (kaafir mushrik), his blood and wealth are Halaal (permissible). The verdict regarding him is the same as regarding an apostate, without any difference.” [Al-Ihkaam fee Usuul al-Ahkaam Vol. 1/73] Can a person become a kafir by obeying other than Allah and his messenger? Yes! This is called shirk At-Taa’ah. Allah said about the Christians: {They took their rabbis and their monks to be Lords besides Allah.} [At-Taobah, 9:31] Although they did not prostrate, or bow down to their priests, they followed them and agreed with them in the forbiddance of the permissible and with the enjoining of the forbidden. Allah therefore considered that as making them (their priests) lords and deities, because the obedience in legislation is a form of worship, and must not be for any one except for Allah, since Allah is the only One who can provide legislation. After mentioning the aayah 9:31 Shaykh Ibn Taymiyyah writes, “One of the ways in which they committed shirk was that they (the rabbis and monks) permitted them things which were forbidden, and they obeyed them, and they forbade them in things which were permitted, and they obeyed them.” [Iqtidaa as-siraat al-mustaqeem] Therefore, anyone who seeks to implement or obey a legislation created by someone other than Allah, is in fact a polytheist. Another evidence for this is the incident which took place during the time of the Prophet Muhammad (salla llaahu alayhi wa sallam) between the followers of Ar-Rahman and those of Shaytan over a dead goat. The polytheist wanted to persuade the Muslims that there was no difference between the goat that the Muslims slaughter, and the goat that dies alone or naturally. They claimed that Allah had slaughtered the dead goat. They came to the Muslims and said, “If the sheep dies, who is the one who kills it?” they said, “Allah killed it.” They said, “are you saying, what you and your companions kill is halal, and what the dog and the falcon hunt and kill is halal, but what Allah kills is haram?” The Mushrikeen also said, “How can it be that what Allah kills with a golden knife is haram, and yet what you kill with your metal knife is halal?” But in reply to this, Allah sent down His Judgement and said: “Do not eat from whatever Allah’s name has not been mentioned over, that is a sin, but the shayaateen (devils) start to whisper with their allies to contend with you. If you obey them you are polytheists.” [An’aam 6:121] This is called Shirk Al Taa’ah, just by obeying them in permitting what Allah forbids, then they are Mushrikeen. قال شيخ الإسلام ابن تيمية في مجموع الفتاوى (٢٨/٥٢٤(: ومعلوم الاضطرار من دين المسلمين وباتفاق جميع المسلمين أن من سوغ اتباع غير دين الإسلام أو اتباع شريعة غير شريعة محمد صلى الله عليه وسلم فهو كافر. Shaykh ul Islaam Ibn Taymiyyah said: And it is known by necessity from the religion (Islam) by the consensus of all Muslims that whoever permits embracing other than Islam or following other than the shareeah of (prophet) Muhammad salla llaahu alayhi wa sallam - is Kaafir (disbeliever). [Majmoo Fataawa 28/524] Al-‘Allaamah Muhammad al-Ameen al-Shanqeeti (may Allah have mercy on him) said: From verses such as that in which Allah says {and He makes none to share in His Decision and His Rule} [al-Kahf 18:26], it is understood that the followers of those who promulgate laws other than those which Allah has ordained are associating others with Allah (i.e. committing shirk). This understanding is explained clearly in other verses, such as the verse which speaks of those who follow the laws of the Shaytaan in permitting dead meat, claiming that it has been killed by Allah [and thus should be permitted]: {Eat not (O believers) of that (meat) on which Allaah’s Name has not been pronounced (at the time of the slaughtering of the animal), for sure it is Fisq (a sin and disobedience of Allah). And certainly, the Shayaateen (devils) do inspire their friends (from mankind) to dispute with you, and if you obey them [by making Al‑Maytah (a dead animal) legal by eating it], then you would indeed be Mushrikeen (polytheists).} [Al-An‘aam 6:121] Here Allah clearly states that they would be Mushrikeen by obeying them. This is associating others with Allah in terms of obedience and following laws that are contrary to that which Allah has ordained -- which is what is meant by worshipping the Shaytaan in the verse in which Allah says: {Did I not command you, O Children of Adam, that you should not worship Shaytaan. Verily, he is a plain enemy to you. And that you should worship Me [Alone, and set up not rivals with Me]. That is the Straight Path.} [Ya-Seen 36:60-61]. And Allah tells us that His Prophet Ibraaheem said: {“O my father! Worship not Shaytaan. Verily, Shaytaan has been a rebel against the Most Gracious (Allah).”} [Maryam 19:44] And Allah says: {They (all those who worship others than Allah) invoke nothing but female deities besides Him (Allah), and they invoke nothing but Shaytaan, a persistent rebel!} [al-Nisaa’ 4:117], i.e., they do not worship anything but a devil, i.e., by following his laws. Hence Allah calls those whom they obey in the sins that they made attractive to them “partners”, as in the verse {And so to many of the Mushrikeen (polytheists) their (Allah’s so‑called) ‘partners’ have made fair-seeming the killing of their children, in order to lead them to their own destruction and cause confusion in their religion.} [al-An ‘am 6:137] The Prophet (blessings and peace of Allah be upon him) explained this to ‘Adiyy ibn Haatim (may Allah be pleased with him) when he asked him about the verse in which Allah says (interpretation of the meaning): {They (Jews and Christians) took their rabbis and their monks to be their lords besides Allah} [at-Tawbah 9:31]. He explained that they permitted to them that which Allah has forbidden and they forbade to them that which Allah has permitted, and they [the people] followed them in that; that is how they took them as lords. One of the clearest proofs concerning that is the fact that in Suuratun-Nisaa’, Allah, may He be glorified and exalted, mentioned those who want to refer for judgement to something other than the laws prescribed by Him and wonders at their claim to be believers, because their claim to be believers even though they want to refer for judgement to false judges shows that they have reached a level of lying which is astounding. That is what Allah says: {Have you not seen those (hypocrites) who claim that they believe in that which has been sent down to you, and that which was sent down before you, and they wish to go for judgement (in their disputes) to the Taaghuut (false judges) while they have been ordered to reject them. But Shaytaan wishes to lead them far astray.} [An-Nisaa’ 4:60] From the divinely revealed texts that we have quoted, it becomes very clear to everyone that with regard to those who follow man-made laws promulgated by the Shaytaan on the lips of his supporters which are contrary to that which Allah has prescribed on the lips of His Messengers (blessings and peace of Allah be upon them), there is no doubt that they are Kuffaar and Mushrikuun, except for the one whom Allah has blinded to the light of Revelation and left to go astray. And he (Al-‘Allaamah Muhammad al-Ameen al-Shanqeeti (may Allah have mercy on him)) said: As for the legal system that is contrary to the laws prescribed by the Creator of heaven and earth, ruling according to it constitutes disbelief in the Creator of heaven and earth, such as the claim that giving precedence to the male over the female in inheritance is not fair and it is necessary to make them equal in inheritance, and the claim that plural marriage is unjust, or that divorce is unfair to the woman, and that stoning, cutting off the hand and so on are barbaric acts that should not be done to people, and so on. Making this kind of system rule the lives of people in society and their wealth, honour, lineage, reason and religion, is disbelief in the Creator of heaven and earth and a transgression against the divine system prescribed by the One Who created all things and Who knows best what is in their best interests; may He be glorified and exalted far above having any lawgiver besides Him. {Or have they partners (false deities) with Allah who have instituted for them in the religion that which Allah has not ordained?} [Ash-Shuuraa 42:21] {Say (O Muhammad to these polytheists): ‘Tell me, what provision Allah has sent down to you! And you have made of it lawful and unlawful.’ Say (O Muhammad): ‘Has Allah permitted you (to do so), or do you invent a lie against Allah?’} [Yuunuus 10:59] {Say: ‘Verily, those who invent a lie against Allah will never be successful’} [Yuunuus 10:69]. End quote from Adwa’ al-Bayaan, commentary on the verse: {And He shares not His legislation with anyone.} [al-Kahf 18:26] Subhânaka Allahumma wa bihamdik ashhadu an laa ilaaha illa anta astaghfiruka wa atuubu ilayk.
