DISCIPLINARY COMMITTEE DESK - (4/4/2014) Last night (3 April 2014) and in accordance with Article 10.3.2.6 of the Constitution of the Botswana Football Association, the Botswana Premier League (BPL) Disciplinary Committee (DC) sat to consider matters involving four (4) persons charged with separate cases of alleged misconduct. 1. In the matter between the Botswana Premier League and Monty Gagomokgwa Monty Gagomokgwa was charged with a single count of misconduct in relation to misbehavior and acts of violence, contrary to clause 14.4 as read with 24.4 and 24.5 together with clause 12.1 of the Botswana Football Association Play Rules and Regulations. This was in relation to alleged acts of misconduct that occurred after the beMOBILE Premier League match between Motlakase Power Dynamos and Township Rollers at the Palapye Swallows Ground on 22 March 2014. Having considered all the evidence led and all submissions made, the Premier League Disciplinary Committee ruled that it was satisfied of the guilt of the Accused person and that full reasons shall follow. Having considered submissions in Mitigation, including the Accused persons service to football, the fact that he was a first offender, that he relies on football as his sole livelihood and that the Accused person was remorseful and contrived, coupled with his kindness with the BPL DC by admitting that he was overpowered with emotion, the BPL DC delivered the following sentence; i) Accused person was find fined P 1000.00 payable in 30 days a) Failure to pay shall lead to suspension from all BFA and BPL activities for a period of 12 months. b) That 2 May 2014 shall be the deadline for the above payment. ii) The Accused person was advised of his right to appeal within the next 10 days to the National Disciplinary Committee. iii) Furthermore he was advised that the decision was unanimous and this was confirmed by every member of the panel. 2. In the matter between the Botswana Premier League and Samuel Kealotswe Samuel Kealotswe was charged with a single count of misconduct in relation to misbehavior and acts of violence, contrary to clause 14.4 as read with 24.4 and 24.5 together with clause 12.1 of the Botswana Football Association Play rules and regulations. This was in relation to alleged acts of misconduct that occurred after the beMOBILE Premier League match between Motlakase Power Dynamos and Township Rollers at the Palapye Swallows Ground on 22 March 2014. The Accused person proceeded to request for more time in order to prepare for his defense and to line-up his witnesses. The case was adjourned to 15 and 16 April 2014. Samuel Kealotswe remains suspended from all BFA activities. 3. In the matter between Botswana Premier League and Isiah Sthanda Mogwadi and Maitlamelo Letlaamoreng Before the matter could proceed, Solomon Mantswe acting on behalf of the two Accused persons requested the DC for leave to raise points in limine before proceeding to the substantive matters. Such leave was granted. Subsequent to their submission, and after due consideration the Premier League decided to withdraw the suspension of the two Accused persons forthwith. In light of the fact that one of the accused persons was absent on compassionate grounds, it was decided to adjourn the matter to Wednesday 9 April 2014, where both will face a single count of misconduct in relation to incidents that occurred after the beMOBILE Premier League match between Police XI and Mochudi Centre Chiefs at the Molepolole Sports Complex on 22 March 2014. Busang Manewe (Chairman), Kagiso Kemoeng, and Thabo Ntshinogang made up the BPL DC Panel for the day while Lesedi Moahi prosecuted all the above matters. Both are free to resume active duties for their Club.
