The Aboriginal Heritage Act 2006 (the Act) commenced operation on 28 May 2007. It is the Victorian Governments legislation for protecting Aboriginal cultural heritage. This review has been conducted according to Section 193 of the Act, which requires the Minister for Aboriginal Affairs to review the Acts efficacy and efficiency by 28 May 2012. The review is aimed at refining and improving the Acts operation with the benefit of five years experience. Latest news The Victorian Government has released an exposure draft of the Aboriginal Heritage Amendment Bill 2014. The Aboriginal Heritage Amendment Bill details proposed changes to the Aboriginal Heritage Act 2006. The proposed changes are informed by the Victorian Government responses to the Review of the Aboriginal Heritage Act 2006, and to the Parliamentary Inquiry into the Establishment and Effectiveness of registered Aboriginal parties. The draft Aboriginal Heritage Amendment Bill 2014 does not include all recommendations of the Victorian Government responses; there are other policy proposals and legislative matters still under consideration. Any further proposed amendments to the Aboriginal Heritage Act 2006 will be introduced by a subsequent amendment bill. An external advisory group has overseen the review process. The group includes representatives from the Aboriginal community, industry, cultural heritage advisors and local government. The review has involved a series of publications (A Discussion Paper, Summary of Submissions and Consultation, the Issues and Options Paper, a Summary Report and a report by PricewaterhouseCoopers on the social and economic impacts of the Act) that have supported and incorporated feedback from a widespread consultation and submission process. Over 140 written submissions have been received. How are the review of the Act and the parliamentary inquiry related? The review of the Aboriginal Heritage Act has been undertaken by Aboriginal Affairs Victoria on behalf of the Minister. The review looked into the operation of all parts of the Aboriginal Heritage Act 2006 and the Aboriginal Heritage Regulations 2007. The Parliamentary Inquiry into registered Aboriginal parties is being undertaken by the Parliament of Victoria. The Parliamentary Inquiry is looking at the processes relating to the appointment and effectiveness of registered Aboriginal parties. Stakeholders have been encouraged to have their say through both processes by making submissions under both the review of the Act and the Parliamentary Inquiry.
