DOPT ORDER FOR SPOUSE POSTING IS NOT APPLICABLE IN IAAD In the DOPT order No 28034/9/2009 DT 30/9/2009 regarding spouse posting it is not mentioned that the order issued in consultation with the C &AG of India for persons serving in IAAD. DOPT order for spouse posting should not be applicable to our cadre as it was not issued in consultation with the C &AG of India, considering that C &AG of India is an Autonomous and Constitutional Body. Also nothing mentioned about spouse posting in the transfer guidelines of C &AG of India. DOPT order speaks only about GOI Ministries &Deptt and C &AG of India is not under control of any GOI Ministries &Deptt. Also it is also not mandatory to abide the DOPT order when the spouses are servicing under different departments or Govt. Offices. So I think some DAs and DAOs are availing the undue advantage of DOPT order and thus staying in Kolkata/home station for a long period. Accordingly some DAOs’ are victimized as transferred out of their home station for many times to cover the term of those DAOs and thus forced to stay outside their home for a relatively long period. So , it is clear that “Law of Equality of opportunity in matters of Public Employment and appointment in terms of clause (1) of Art 16 of the Constitution and Equality Before Law in terms of Art 14 of the Constitution” is not maintained -though all of us doing our service in a similar circumstances and in similar conditions. So, our central level and state level leaders should place the matter to the appropriate authorities, because I think the association cannot remain silent when few members take illegal advantage at cost of the interest of other members.
