DOUBLE TAKE- NEW PRIVACY LAWS AND THE IMPACT ON YOUR BUSINESS Have you set aside time to look at how your business manages privacy? New changes to the Privacy Act 1988 (Cth) have come into effect as of 12th of March, 2014 which introduce a new set of privacy principles covering how businesses handle and process personal information, use information for direct marketing and disclose personal information to people and businesses overseas. The implementing legislation, the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth), also introduces new powers for the Information Commissioner to investigate and prevent breach and ensure compliance. There are also new civil penalty provisions of up to $340,000 for individuals or $1.7 million for organisations found to be in breach of the Privacy Act - and the Information Commissioner has indicated they will not “shy away” from using the new penalties. The Privacy Act 1988 (Cth) protects personal information handled by large businesses, health service providers of any size and small businesses with an annual turnover of more than $3 million that trade in personal information, are related to a larger business or otherwise fall under the Act.
