DR. JEFFREY KITINGAN CALLS FOR DE-COLONIZATION OF SABAH & SARAWAK & RE-NEGOTIATE MA63 News report of Kitingan Australian speaking tour MELBOURNE REPORT: Dr. Jeffrey Kitingan (MP Bingor Sabah) spoke on Malaysia at a Crossraod and the Malaysia Agreement 1963 on Tuesday night 24 June 2014 at a well attended forum of over 50 people held by the Saya Anak Bangsa Malaysia in Melbourne . The Malaysian Consul also attended with a photographer. The Forum was reported in Wiki Sabah News Report but it failed to mention an important aspect of his talk. Amongst the points reported in Wiki Sabah News, Kitingan also said Malaya should effectively complete the de-colonization of Sabah and Sarawak. It was in this context that he offered a solution to the Kuala Lumpur government to re-negotiate the MA63. Mr. Waytha Moorthy Ponnusamy a leader of HINDFRAF also spoke at the meeting where he drew attention to the widespread public discussion on Sarawaks right to national self-determination. He mentioned that the Malaysia Agreement was void for several reasons one of which was Britains breach of the 1946 Cession Treaty to restore Sarawak independence. The other reason MA63 is void is that Singapore independence from Malaysia in 1965 abrogated the MA63 (which meant the original concept ceased to exist). He also said Sarawak people could sue the British Government for breach of trust in relation to the 1946/1963 breach for incorporation Sarawak into Malaysia without giving independence first (as demanded by the nationalists). A senior Australian barrister who was consulted on this point opined that Britains breach of the 1946 Cession agreement to restore Sarawak independence and making of MA63 while Sabah and Sarawak were still colonies meant that formation of Malaysia was really an annexation of Sabah and Sarawak under Malayan rule. He confirmed colonies (unless subject to certain situations) had no capacity to enter into international treaties, thus affirming that the MA63 is void and not binding on all the signatory parties. The Malaysian Consul also attended the meeting and declared that Sabah and Sarawak should be fully integrated with Malayan states by abolishing the 2 countries reserved migration control. He comment was met with silence. Beng Kor has posted the Wiki Sabah News on his Face Book with the comment: If you still want to talk about Malaysia Agreement 63, that would be an internal affair, and UN cannot interfere in internal affair, why dont we let UN to re open Malaysia Agreement in UN Sarawak Referendum Meeting? Instead of making ourselves a fool for Malaya to toy with ? https://facebook/groups/Sarawakforsarawakians Borneo Wiki agrees with Beng Kor to an extent but opines that MA63 must be exposed as a void international agreement and in this context the UN can be brought in to re open MA63 and assist in the referendum process. However, logically if MA63 is void there is no need for a referendum.
