DUBLIN CITY COUNCIL NORTH CENTRAL AREA COMMITTEE 21st November 2011 Q.65 Question in the name of Councillor Micheál MacDonncha “To ask the Area Manager if she will outline the duty of care of the Council regarding premises leased from the Council for community use such as Kilbarrack Community Hall, given the poor state of repair of that Hall, currently being leased by KADCA; if health and safety inspections have been carried out on this premises; and if she will make a statement on the matter.” Reply: The Community Centre at Greendale Road is leased from Dublin City Council by KADCA. Dublin City Council as Landlord is not in occupation of the Community Centre nor has it any control over the Community Centre. As such any duty of care that is owed to occupiers, users and visitors to the Centre is owed by KADCA. KADCA as the leaseholder is responsible for health and safety matters. With regard to the condition of the building, the building was inspected by the Council’s City Architects Division on behalf of the Property Management Section. Following this inspection and in accordance with the lease the Council’s Law Department wrote to Solicitors acting on behalf of KADCA enclosing a Schedule of Repairs and advised that KADCA has three calendar months to complete the works. The Solicitors on behalf of KADCA have sought some clarification in respect of the repairs and the Property Management Section in conjunction with the City Architects Division is endeavouring to provide such clarification.
