DUIT EPF SIMATI “There was a fatwa relating to nominations for the Employee Provident Fund (EPF), which came out in 1973. It says that if a Muslim appoints someone as his or her EPF nominee, and (upon the demise of the account holder), the nomineecan only act as a trustee and must distribute the EPF money according to faraid, after all debts of the deceased are settled. Under civil law, the nominee takes the money as his or her own. So, if a Muslim nominee were to (all) the money and not distribute it to the rest of the faraid heirs, is it a clear breach of trust? No, because under our law, no crime has been committed. So, what is the purpose of having a fatwa if there is no follow-through? Dr. Aziz Hassan Lawyer, and an expert is Islamic Succession and Inheritance issues My comment: Basically, just because you are the nominee, from the Islamic point of view, the money is not entirely yours when the account holder dies. Moreover, I think our JAKIM, JAIS etc should have a strong legal department to rectify all these sort of anomalies in our legal system. Islam first and foremost uphold justice and fairness. They should spend their resources doing these sort of things rather than tangkap basah, skodeng, halal haram itu dan ini. Use more brains than doing brainless work.
