DUKE STREET STATION HOMEOWNERS ASSOCIATION POLICY RESOLUTION NO. 2006-1 (Pertaining to Resident and Visitor Parking and Towing of Vehicles) This Resolution supercedes and replaces all other Parking/Towing Resolutions: #4 (Parking, 1994); #98-7 (Visitor Parking Spaces, 1998); and #5 (Towing Of Vehicles Which Extend Over Sidewalk Into Street) and 99-1 (Pertaining to Parking and Towing of Vehicles). WHEREAS, Article II, Section 2.01(e)(i) of the Declaration grants the Association the right to adopt, amend, and enforce reasonable rules and regulations pertaining to the use of the Common Areas which shall enhance the preservation of the Common Areas and the safety and convenience of the users of them; WHEREAS, Article 55-513 of the Virginia Code grants the Board of Directors the power to establish, adopt and enforce rules and regulations with respect to the use of the Common Areas and with respect to such other areas of responsibility assigned to the Association by the Declaration; WHEREAS, Article III, Section 3.05 of the Declaration, Article V of the Articles of Incorporation, Section 3.1 of the Bylaws, grant the Board of Directors the right to manage the affairs of the Association; IT IS THEREFORE RESOLVED that the following Policy is adopted by the Board of Directors of the Duke Street Station Homeowners Association to govern Parking and Towing of Vehicles. GENERAL 1. This Policy is adopted for the benefit, comfort and convenience of all residents and visitors in the Community and is intended to provide fair and adequate parking for all residents and visitors of Duke Street Station. 2. This Policy will take effect January 1, 2007 and applies weekdays from 5:00 p.m. until 5:00 a.m. the following morning and all day Saturdays, Sundays and holidays. 3. One-half (1/2) of all of the Common Area parking spaces are hereby designated for Visitors Parking only. Residents’ vehicles may not be parked in spaces marked for Visitor Parking. All other Common Area parking spaces will remain unmarked (“open”) and will be available for use by residents on a first-come first served basis, subject to restrictions that are defined elsewhere in this Resolution. 4. One (1) Visitor Parking placard will be issued to each Duke Street Station home. A fee of $5.00 will be charged for each placard that must be replaced. The Board of Directors recommends that Visitor Parking placards be voluntarily shared among neighbors, as needed, to accommodate residents who have multiple guests. 5. Parking is permitted only in designated paved areas. Parking is not permitted in the driving lanes, including Battlement Way, Beauregard Street and Observation Way, except in the specifically designate (marked) areas/spaces. Parking is prohibited in fire lanes and in the driving lanes directly in front of any driveway. 6. Vehicles parked in driveways may not extend over the sidewalk or into driving lanes. 7. No commercial truck, commercial bus or other commercial vehicle of any kind may be kept or parked overnight on any portion of the Association’s property without the written approval of the Covenants Committee. 8. No boat, trailer, junk vehicle, or other vehicle without current registration plates displayed, motor home, or portable vehicle (other than automobile) may remain parked in a location visible from any roadway without the written approval of the Covenants Committee. RESIDENT PARKING 1. No vehicle belonging to a resident may park in the non-visitor (“open”) Common Area parking spaces longer than four (4) consecutive days. Parking for any portion of one day will constitute parking for one whole day. Attempts to circumvent this policy by moving the same vehicle to a different parking space will not be permitted. 2. Residents are entitled to use their garages and driveway spaces for their own vehicles or for visitors/guests, consistent with the Governing Documents of the Association. 3. Residents’ vehicles may not park in the Visitor Parking spaces. VISITOR PARKING 1. During the times and on the days when this Policy is in effect, all Visitors’ cars that are parked in Visitors’ spaces must display a Duke Street Station Visitor Parking placard that is visible on the dashboard. 2. Any vehicle that is found in a Visitor parking space during the times and on the days when this Policy is in effect that does not display a Visitor Parking placard is subject to being towed without warning and at the owner’s expense. 3. For purposes of this Policy, a “Visitor” is someone who is not a resident of Duke Street Station and who parks on an occasional basis while visiting a resident of Duke Street Station. 4. No vehicle may make use of the Visitor spaces longer than four (4) consecutive days. Parking for any portion of one day will constitute parking for one whole day. TOWING 1. Any vehicle that is found in the Duke Street Station community in violation of this Policy will be towed at the owner’s expense. 2. Any charges incurred by the Association in removing a vehicle that violates the Policy may be assessed against the Homeowner Association account of the owner of the home with which the vehicle is affiliated. 3. Neither the Association, the Board of Directors, the Management Agent, nor the Management Company will be responsible for vehicles that are towed pursuant to this Policy. 4. The Board of Directors of the Duke Street Station Homeowners Association encourages any resident who observes a vehicle parked illegally in a fire lane (or otherwise parked in a manner which may obstruct access by emergency personnel) to call the tow company to request the immediate removal of the vehicle in question. This Policy will be effective on January 1, 2007.
