Dear All, Greetings of the day! Circular 10/2014 dated 07.05.2014 has further raised the accountability on practicing professional and authorized signatory authenticating any document being filed with MCA and laid harsh provisions in case of wrong authentication. Where any instance of filing documents containing false or incomplete information or omission of material fact is observed, an inquiry can be conducted against the professionals who certified the form and signatory thereof including an officer in default who appears prima facie responsible for submitting that information. Moreover, the Digital Signature Certificate shall be de-activated by the Central Government till a final decision is taken in this regard. As per Chapter XXIV - The Companies (Registration Offices and Fees) Rules, 2014, the authorized signatory and the professional, if any, who certify e-form shall be responsible for the correctness of the contents of e-form and correctness of the enclosures attached with the electronic form. We have entered in the 4th year of XBRL, still our research team has observed many irregularities in documents created by companies and various conversion service providers.
