Professor Treves, International Tribunal for the Law of the Sea (ITLOS) M/V Saiga (no.2) (Saint Vincent and the Grenadines v. Guinea) Judgment (1 July 1999), para 155. The preservation and implementation of Human Rights has traditionally been the prerogative of States, most notably those who are signatories to international Human Rights’ Conventions. More recently, the onus has been recognised as logically extending to integrate into the area of corporate responsibility by entities engaged in commercial business and as reflected in the UN Guiding Principles for business and human rights (UNGPs), otherwise known as the Protect, Respect and Remedy Framework. The UNGPs relates to developing corporate policies for associated compliance pathways, including Human Rights Impact Assessments. They reflect the requirement for duties of care, not just towards corporate clients, employees and interested third-parties, but ultimately go to the corporate entity’s own reputation and standing in the market place. This includes the maritime industry. David has notable international practice covering public international, commercial, criminal and maritime law.
