Dear Dennis, We refer to our conversation of even date. As discussed during this call, our office met with the Taxi Services Commission to discuss the online register. Our office was advised that pursuant to the Transport Compliance and Miscellaneous Act 1983, the Commission is required by law to maintain an electronic register which contains the business contact details of industry participants including operators, network service providers and licence holders. The register will contain participants phone numbers, fax numbers, postal addresses, email and internet addresses. The Taxi Services Commission has explained that the rationale for this register is to promote greater service accountability. We understand that participants have been notified of this in writing and given an opportunity to change their address for service (to remove home details) should they have concerns about this information being publicly available. We have been advised that participants are also able to request that their contact information is removed from the register, where there are exceptional circumstances. We understand that participants may perceive this register as intrusive. However, given the register is permitted by law, our office is unable to conclude that this register interferes with an individuals privacy rights. We are therefore unable to further assist you with your enquiry. If you wish to discuss this matter with the Taxi Services Commission, you are welcome to contact the Commissions privacy officer, Ms Emily Dickson. Her email address is [email protected] We understand that you also have the right to refer this matter to the Victorian Civil and Adminstrative Tribunal, for review. Kind Regards, Senior Policy and Compliance Officer
