Dear Elio Motors Reservation Holders and Residents of NY, As you probably know, NY is one of a few east coast states that have yet to address the motorcycle endorsement issue for three-wheel vehicles like the Elio. NY did promulgate a rule exempting helmets for “three-wheel enclosed vehicles” under statutory authority granted to the Commissioner of the DMV (Sections 215 and 218 of VTL), but not endorsements. Endorsement Issue Facts: AAMVA (American Association of Motor Vehicle Administrators) has researched this issue for over a year and has concluded that autocycles: 1) Have handling characteristics like automobiles, not motorcycles. 2) Have automotive controls, no motorcycle controls. 3) “Strongly recommends” that states pass exemptions for motorcycle endorsements for autocycles for “consistency across all jurisdictions” People traveling to NY from surrounding states like PA, NJ, NH and CT will not be able to travel with an autocycle in NY unless they get an endorsement on their license without possible punitive action. This is where we could use your help! In the next couple of days we ask that you call and email Representative Gantt and Senator Robach and let them know your thoughts and how important this issue is to you. Consider points below to include: • Autocycles shouldn’t have a special endorsement. They have automotive controls and they handle like a four-wheeled car. The endorsement road test for this type of vehicle would be nonsensical. It is a completely unnecessary bureaucratic burden to every NY resident’s purchasing one of these vehicles, including the many seniors that have reserved the Elio. • Because the Elio is too wide (72”) and too long (13”6”) it cannot pass the three-wheel road test. • Requiring motorcycle endorsements for autocycles provides no measurable increase in safety. Again, we are requesting attention be given to resolve this issue, either by recommending a Commissioner Rule change or legislative action.
