Dear Mr. Kaiser, This disclosure is in further response to your Freedom of Information Privacy Act (FOIPA) request to FBI Head quarters (FBIHQ) for records concerning Edwin B. Kaiser Jr. and administrative appeal number 2010-0644 to the Department of Justice/Office of Information (DOJ/OIP). By letter dated January 29, 2010, the DOJ/OIP advised that some of the information responsive to your request is classified and that material would be referred to the Department of Justice Review Committee (DRC) for further review and determination on whether the information warrants continued classification under Executive Order No. 12958. Which is a National Threat to Security. Executive Order No. 12958 Sec. 5.5. Information Security Policy Advisory Council. (a) Establishment. There is established an Information Security Policy Advisory Council (Council). The Council shall be composed of seven members appointed by the President for staggered terms not to exceed 4 years, from among persons who have demonstrated interest and expertise in an area related to the subject matter of this order and are not otherwise employees of the Federal Government. The President shall appoint the Council Chair from among the members. The Council shall comply with the Federal Advisory Committee Act, as amended, 5 U.S.C. App. 2. (b) Functions. The Council shall: (1) advise the President, the Assistant to the President for National Security Affairs, the Director of the Office of Management and Budget, or such other executive branch officials as it deems appropriate, on policies established under this order or its implementing directives, including recommended changes to those policies; (b) Members shall not jointly conduct or dispose of agency business other than in accordance with this section.
