Dear Shrimati/Shriman, IRONY OF JUDICIAL SYSTEM The Judicial System of India is in the lime light especially not for the good reasons but otherwise. There are numerous examples when the Judicial System was under the scanner but almost every time the Judiciary came up with the desired results. But, recent judgment of the High Court of Punjab & Haryana delivered in the case of Mr. Kuldeep Bishnoi Petition regarding defection as once against saddened the common people and reaffirmed the perception that Judiciary is also selectively favoring the highly influential people particularly in the political arena . The Judgment clearly depicts that how Judiciary allowed these defectors to run their show according to their own whims i.e. to run a unconstitutional Govt. against all ethics and established principles. Not only the judgment was prolonged to favour them but they were again allowed to run their show by not disqualifying them further for contesting the forthcoming elections which atleast should have been in conformity with the established norms and conventions. Similarly, granting parole on Medical Grounds to Mr. Om Prakash Chutala Ex-Chief Minister of Haryana has once again exposed the system prevalent that how this mighty class takes the judiciary for granted by en-cashing upon on the lacunas under the law. While common man has to pass through number of harassments and even remedies to which they are entitle under law are not made available to them. The another facet of coin Mr. Laloo Prasad who has been convicted is roaming freely and availing all the benefits and facilities for his political gain like other politicians then What is the effect of conviction? It seems that the Politicals convicted stalwarts i.e Laloo Prasad Yadav, Om Prakash Chutala and Madam Jayalalita will enjoy the lavish life. These are the few glaring examples although there are so many. The judicial system is the only hope and that is why people held the judiciary in high esteem because of its impartial role. At present its role has become more important because Mr. Narendra Modi is in absolute majority although he is doing a fabulous job but, if he does otherwise then only Judiciary can come to rescue as absolute power corrupts absolutely. Right now, the need of the hour is accountability and transparency in the system. In Bishoi’s case every person got scot free and nobody was made accountable and the same is in the other related matters. As a result thereof, common man and country suffers. Therefore, judiciary should introspect and must remove all the loopholes in the system. The Hon’ble Supreme court should take cognizance of the above instances to keep the image and prestige of the judiciary as well as of the country by getting suitable and requisite changes in the present system. De-facto there seems to be two sets of law one which deals with the common man and other which deals with the highly and sophisticated politicians which needs to be done away with urgently in public interest as well as to keep our democracy intact and vibrant.
