To The Honble Chief Justice High Court of Judicature at Madras Chennai. 600 104 Sir, We would like to bring the following for your kind consideration. One of the Judges in the Madras High Court, Mr.Justice C.T.Selvam against whom there are several complaints, continue to stifle freedom of expression and speech guaranteed as a fundamental right under the Constitution. Though the portfolio of 482 Cr. P.C. has been changed and Justice C.T.Selvam is handling a different portfolio, Justice Selvam continues to handle Crl. O.P.27389 of 2013 in which a woman advocate has sought investigation into an alleged offensive posting in the website savukku.net. Due to personal animosity, Justice Selvam, continues to hear the case and every week issues fresh orders not only to close down the website but also to block the facebook account of one Achimuthu Shankar who is alleged to be running the website. It is pertinent to note that Justice Nagamuthu, who granted bail to Achimuthu Shankar in Crl. O.P. 2494 of 2014, has categorically held that there is no material whatsoever to connect the said Achimuthu Shankar with the website savukku.net. Further, Justice C.T.Selvam vide his order dated 13 April 2014 in Crl. O.P. 27389 of 2013 had entrusted investigation to a private organisation viz. National Cyber Safety Security and Standards which paved the way for a private person to conduct investigation and interrogation of a suspect under nose of cyber crime officials. The continuance of the case in Crl. O.P. 27389 of 2013 before Justice C.T.Selvam, would pave way for killing freedom of speech and expression through judicial orders. We pray the Honble Chief Justice to kindly intervene and withdraw the case in Crl. O.P. 27389 of 2013 from the docket of Honble Mr.Justice C.T.Selvam and render justice. Yours sincerely
