Dear friends, as a member of the Knesset I deal among other matters with demands that are addressed to me by the public, I want to share with you a recent story. It is a child of Ethiopian origin aged two and a half years, whose aunt is an Officer in Tzahal (Army), who came to see me looking for help. She told me that shortly before the birth of the child (the mother) her sister fell into a mental instability, which led the authorities to place the child right out of the hospital in a house of children on social assistance. The woman I met is an economist, that is very impressive pouring her heart saying: I want my nephew, I wanted to grow him since birth. My sister became mentally ill, she admits, but isnt it right that in such situations it is better to have family around? She says that she sought from the very beginning to accommodate the child with her. They promised me that they are in the process of dealing with the case and that there is nothing to fear, in vain. Meanwhile, the mother saw the child once a week or once every two weeks, and despite of all the good will, she, and everyone around knew she could not raise her child. The law established the primacy of the family in this kind of situation, concerning the child. Yet in this case, the child was transferred to a non-Ethiopian adoptive family, which tried hard to get the child at the age of one year. It was the beginning of an intense and painful struggle. Justice and the officer (aunt), agree that it would have been better if the child could know his origins and grow within his Ethiopian family. Justice has established that he had the necessary conditions to be raised by his aunt. However, social assistance, has persistently said that his transfer anew risk of destabilizing because he is accustomed and returning to his family of origin may demmage him. Given these standpoints, Justice preferred not to intervene, leaving the child to his fate, with the adoptive family. Yet recent expertise has established that there were many anomalies in the verification of the ability of the child to be adopted as the reason we ended up in this kind of situation entirely preventable, and that the officer is greatly able to raise the child. In addition, the court decided a few days ago, the final separation of the child from his mother and aunt, who no longer have the right to see him at all. The reason given is the welfare of the child. After studying this history, it was clear to me that the law and a real chance to be together has been removed from this family. We can no longer ignore his origins and the fact that he will ever know that he was adopted. I do not know what you think but I decided to help the family of the child, and Ive already sent the story to the Minister of Social Affairs, because I believe that every newborn has the right to live within his family, culture and heritage. While we trample this right the injustice is glaring. Il sagit dun enfant dorigine Éthiopienne âgé de deux ans et demi, et dont la tante est une officière à Tzahal (l’armée), qui est venue me voir, à la recherche dune aide. Elle ma raconté que peu avant la naissance de lenfant, (la mère) sa sœur est tombée dans une précarité mentale, qui a conduit les autorités à placer lenfant dès sa sortie de lhôpital dans une maison denfants de lassistance sociale. La femme que jai rencontrée est une économiste, très impressionnante qui sest épanchée me disant : Je veux mon neveu, je le voulais depuis sa naissance. Ma sœur, est devenue mentalement malade, elle admet mais nest-ce pas dans ce genre des situations quil vaut mieux avoir la famille autour ?! Elle raconte avoir demandée depuis le début daccueillir lenfant chez elle. On ma promis quils sont entrain de traiter laffaire et quil ny a rien à craindre, en vain. En attendant, la mère voyait lenfant une fois par semaine par une fois deux fois par deux semaines, et malgré toute la volonté, elle, ainsi que tout le monde savaient quelle ne pouvait pas lélever. La loi établi la primauté de la famille dans ce genre de situation, à légard de lenfant. Mais dans la dite situation, lenfant a été transféré à une famille dadoption non éthiopienne, qui sest activé à lavoir dès lâge dun an. Cétait le début dune lutte intense et douloureuse. La justice ainsi que lofficière (la tante), saccordent à dire quil aurait été mieux si lenfant pouvait connaître ses origines et grandir au sein de sa famille éthiopienne. La justice a établi quil aurait eu les conditions nécessaires pour sélever chez sa tante au grade supérieur. Cependant, lassistance sociale, sest obstinée à dire que son transfert à nouveau risque de le déstabiliser, car il sest accoutumé et que son retour à sa famille dorigine lheurterait. Vue ces prises de positions, la justice a préféré de nest pas intervenir, laissant lenfant à son sort, chez sa famille adoptive. Or une expertise a constitué quil y a eu beaucoup danomalie lors de la vérification de laptitude de lenfant à se faire adopter, faute de quoi on se retrouve dans cette situation tout à fait évitable, et que lofficière est grandement capable de lélever. En plus, la justice a décidé il y a quelques jours, la séparation définitive de lenfant de sa mère et sa tante, qui nauront plus le droit même de le voir. La raison avancée est le bien être de lenfant. Après avoir étudié cette histoire, il métait clair que le droit ainsi quune vraie chance dêtre ensemble a été ôtés de cette famille. On ne peut ignorer ses origines non plus et le fait quil saura à jamais quil est adopté. Je ne sais pas ce que vous en penser mais jai décidée daider la famille de lenfant, et je me suis déjà adressée au ministre chargé des affaires sociales, car je crois que chaque nouveau-né a le droit de vivre au sein de sa famille, culture et son héritage. Alors que lon piétine ce droit linjustice est criante. Bonne semaine
