Defendant Boehringer Ingelheim Sanctioned for Discovery Violations in the Pradaxa Litigation The Plaintiffs continue to gain momentum against Boehringer Ingelheim in the Pradaxa Litigation. After a series of blatant discovery violations and disregard for court orders, Judge Herndon ordered corporate officers of Boehringer Ingelheim Pharmaceuticals to personally appear in court. At the conference, Judge Herndon detailed the long list of violations by the defense. The Plaintiff’s request for sanctions and mandatory injunctions was granted. Judge Herndon imposed a nearly $30,000.00 find in addition to a number of mandatory injunctions designed to prevent further discovery violations and delays. The sanction and injunctions come at a critical time in the litigation as Plaintiff’s attorneys are hard at work taking depositions of key witnesses at Boehringer Ingleheim. “The documents that will be produced as a result of the injunctions will yield critical information that will further bolster Plaintiff’s theories about the safety and efficacy of Pradaxa” says Meyers & Flowers attorney Brian Perkins. Meyers & Flowers advocates for each of its Pradaxa clients through its work on the Pradaxa Executive Committee, Discovery Team, Science Team, and through the litigation of a Bellwether case in the MDL.
