Do military commanders abuse the broad discretion they are given to over-punish minor infractions with heavy-handed administrative sanctions? Yes, they sometimes do, and there are no meaningful safeguards in the process. Now, the issue has the attention of the White House. This could become a bigger deal than it seems on the surface. One of the best arguments for preservation of a separate military justice system is to preserve the administrative/non-judicial latitude of commanders to maintain good order and discipline. If that latitude turns out to be a source of more harm than good, the rallying cry to the end the UCMJ/MCM outside of warzones could regain the traction it had last year.
