Do you leave your kids unattended in the car? At home? Please read FOR VICTORIA - I have been sending this weekly to Federal Scott Morrison and the Labor Leader Dan Andrews, who increased jail times and penalties for leaving kids in cars. Now it is logical that an older child is not under the strict laws, since they can open the door themselves etc but the actual law they use for these penalties is for children, being aged 16 or under. So if this is the law, then where do we stand with leaving kids in the home to work. Its not a matter of if you would or would not or its up to the parents, is it ILLEGAL is my question. Is it fair for it to be a matter if nothing goes wrong its not illegal but if the house catches fire it is illegal, that just cannot be the law or should not be. No replies yet, but if anyone else would like to help in asking the question, feel free to!! Dear Ministers, Regarding the tough new laws for leaving children in cars that has been headline news in Victoria. The recent increase in penalties that fill our media leave me wondering were things stand on a real legal level, 6mths jail is a hefty penalty. The actual law does not even use the word car in its definition. However it states the following: 494. Offence to leave child unattended (1) A person who has the control or charge of a child must not leave the child without making reasonable provision for the childs supervision and care for a time which is unreasonable having regard to all the circumstances of the case. Penalty: 15 penalty units or imprisonment for 3 months. I am a single parent, the labor and liberal government have demanded i work and reduced income support with 3 mths notice at the start of 2013 to levels well below poverty and what is needed to provide a basic life. The idea of work being more important fueled this. Now there is no school holiday programs for children once they reach 12! So during 3 mths of every year i wonder what parents are supposed to do with children 12 and up. If i leave a 12yr old home after school for an hour, after they have gotten themselves home, alone where does this law stand? Society is happy for this to occur, yet if he waits in the car, usually playing on a phone or gadget I can face huge fines and jail? Please advise me ASAP if i leave my 12yr old home for this period, or even for a whole day in the case of school holidays is this LEGAL under the states definitions of the law? I look forward to having reality and the legal standing explained in terms ALL people can interpret. It is time this irony was addressed fully and either law changes made to reflect the age of a child or else on a national level this factor needs to be addressed when forcing poverty on single parents. We do what is expected but break the law to do it? I await this result eagerly! Thank you for providing information quickly due to the chance I will be successful in a recent employment application, but i do not wish to break the law. We deserve to know what the real law is, and deserve to have this explained in its entirety.
