Does anyone know the correct answer to this? Does signing a new AST under the current housing act cancel out an old style protected tenancy? The original occupier of the protected tenancy no longer resides at the address and at least one other AST has been signed and now a new AST has been signed. My belief here is that when a new tenancy is signed it supercedes all previous tenancies. For example you cannot evict using section 8 for arrears based on a previous tenancy only arrears accrued during the current tenancy. So there is an implication the old AST is null and void. Using that theory then the protected/regulated tenancy is the same. The moment a new AST is signed they are bound by that contract only. It would be interesting to here of the legislation / case law that would support this theory if anyone knows out there.
