EDIT: OK I have just re-read the article, it seems that it must be refused and the onus is on the defendant to show why they must be granted bail. Nonetheless, a huge waste of court time and state resources. If the Magistrate believes that they are a risk to society- then bail would be denied anyway -- So I saw this that bail must be denied for serious offences in NSW Then you can read the comments- what people dont understand is how the criminal legal system works. Police will always put the highest charge they can at first to ensure that when it fails it will fall down to another charge that is less significant - e.g. intentionally causing serious injury typically fails and falls down to recklessly causing injury (Mind you Im from VIC so quoting VIC laws here but nonetheless they are the same) Police typically do not request remand for intentionally causing serious injury if they believe it was an isolated incident between two parties who knew each other (not a random attack). So essentially what is going to happen is that every single person charged with serious indictable charges will be denied bail (mandatory). This is stupid on so many levels, has not been thought through.
